2007 Official Rules

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

1. TO ENTER: To enter go to, www.ebonyjet.com, and complete the official entry form and click “enter.” No mechanically reproduced entries will be accepted. All entries must be received from 12:00 AM (CT) on December 19, 2007, through 11:59 PM (CT) on February 29, 2008. Limit one entry per person. If more than one entry is received from one person, only the first entry submitted will be considered valid. Sponsor will not verify receipt of entries. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business or educational institution) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Sponsor is not responsible for lost, late, illegible, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic. Entries are the property of Sponsor and will not be returned. Offer void where prohibited and subject to federal, state and local laws.

2. Eligibility: The Sweepstakes is only open to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older as of the date of his/her entry. Employees of Sponsor, PepsiCo, Inc., D.L. Blair, Inc., or any of their directors, officers, affiliates, dealers, subsidiaries, agents, advertising agencies, promotional agencies, manufacturers, distributors, sponsors, licensees, prize suppliers or any other party involved in the development, administration, production, operation or judging of the Sweepstakes, their immediate families (spouses, parents, children, siblings and each of their respective spouses), and persons living in the same household of such individuals are ineligible. Any person who has won a Johnson Publishing Company contest or sweepstakes in the prior twelve (12) month period is also ineligible.

3. PRIZES: Grand Prize. One grand prize (1) winner will receive a three (3) day/two (2) night trip consisting of: (a) round-trip main cabin airline transportation for two (2) persons to Chicago, Illinois, from the airport nearest the winner’s permanent residence at the time of entry (or ground transportation if winner resides within a 200 mile radius of Chicago); (b) two (2) one-day admission tickets to the DuSable Museum of African American History; (c) a tour of the Johnson Publishing Company, Inc. headquarters; (d) two (2) nights hotel accommodations in one (1) double-occupancy room in Chicago; and (e) roundtrip ground transportation to/from the airport in Chicago. Approximate retail value $2,600 depending upon winner’s point of travel origin. Meals, gratuities, and all other expenses not specified are the responsibility of the winner and his/her guest (including all taxes). Airport, airline, ground transportation, and hotel to be selected by Sponsor in its sole discretion. Travel must be completed before October 31, 2008. The winner and guest must travel together. The winner and guest (or parent/guardian if guest is a minor) must sign a Release of Liability/Publicity Form prior to the award of the prize to travel or will not be allowed to travel. All travelers must possess required travel documents (e.g., valid photo identification) prior to departure. If the guest is a minor, the winner must be his/her parent or legal guardian. The grand prize winner will be issued a 1099 tax form for the actual retail value of the prize. First Prizes. Ten (10) first prize winners will each receive a Pepsi gift pack which will contain: (a) one (1) EBONY Magazine T-shirt; (b) one (1) coupon for a free case of Pepsi; (c) one (1) copy of the book, “Bridges of Memory” published by the DuSable Museum, and (d) one (1) “The Firsts of Many” calendar. (ARV $45). Prizes are not transferable. No cash redemptions or prize substitutions will be allowed. All prizes will be awarded. All taxes, including federal, state, and local are the sole responsibility of all winners. Only one prize per family or household.

4. DRAWING: Winners will be determined in a random drawing from all entries received. Drawings will be held on or about March 6, 2008, by D.L. Blair, Inc., an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. First prize winners will be notified by mail. Grand prize winners will be notified by telephone, e-mail and/or overnight mail. The potential grand prize winner will be required to sign and return an Affidavit of Eligibility/Liability/Acceptance/Publicity Release Form, which must be returned within seven (7) calendar days after notification is mailed or the prize will be forfeited and awarded to an alternate winner.

5. ODDS OF WINNING: Odds of winning will depend upon the number of eligible entries received.

6. GENERAL: By entering and participating in the Sweepstakes, participants and winners agree: (a) to be bound by the Official Rules and the decisions of Sponsor and sweepstakes administrator, which shall be final in all respects; (b) to the use of their names, pictures, portraits, photographs, voices and likenesses for advertising, trade and promotional purposes in all media (including the Internet) worldwide without additional compensation, except where prohibited by law; and (c) to release, discharge, and hold harmless Sponsor, its sweepstakes administrator, promotional partner, and their affiliates, agents, officers, directors, and employees from any and all liability, loss, damage or claims to person or property, due in whole or in part, directly or indirectly, arising out of their participation in the Sweepstakes and the participation of his/her guests in the Sweepstakes and/or the award, acceptance, receipt, possession, use and/or misuse of any prize. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes should virus, bugs, technical failure, non-authorized human intervention or other cause(s) beyond the control of Sponsor corrupt or impair the administration, security, fairness, integrity, or proper play of the Sweepstakes. In such event, a notice may be posted at www.ebonyjet.com, and Sponsor may award prizes in a random drawing from all eligible entries received up to the date of cancellation or suspension. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. Caution: Any attempt by an entrant to deliberately damage the website or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages (including attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution.

7. LIMITATIONS OF LIABILITY: Sponsor is not responsible for and disclaims any liability for any technical, hardware, software, malfunctions, computer system, server, Internet service provider, telephone failures, or any combination thereof, or for any other errors of any kind, lost or unavailable network connections, fraud, incomplete, garbled or delayed computer transmissions, whether caused by Sponsor, users, or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of submissions which may damage a user’s system or limit an entrant’s ability to participate in the Sweepstakes. Sponsor is not liable for any delay or failure to render the prizes directly or indirectly due to or resulting from causes beyond its control, including, but not limited to, acts of God or the public enemy, war, insurrections, riots, fires, floods, epidemics, quarantine restrictions, severe weather, explosions, accidents, governmental priorities or allocations, strikes or labor disputes, inability to obtain necessary materials, accessories, or the adoption or enactment of any law, ordinance, regulation, ruling or order that adversely affects Sponsor’s ability to deliver the prize(s). Sponsor has neither made nor is in any manner responsible for, and hereby disclaims, any warranty, representation or guarantee (express or implied, in fact or in law) relative to any prize or use and enjoyment of any prize. Except where prohibited by law, as a condition of participating in the Sweepstakes, entrants agree that any and all disputes and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively pursuant to the laws and jurisdiction of the State of Illinois, without regard to conflicts of law provisions thereof. UNDER NO CIRCUMSTANCES WILL PARTICIPANT(S) BE PERMITTED TO OBTAIN AWARDS FOR PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES. ANY AND ALL CLAIMS, JUDGEMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES, BUT IN NO EVENT, ATTORNEY’S FEES. Some jurisdictions may not allow the limitations of exclusions of liability for incidental or consequential damages, or exclusion of implied warranties; some of the above limitations or exclusions may not apply. Check local laws for any restrictions or conditions regarding these limitations and/or exclusions.
